1. General Agreement & Scope
These Terms and Conditions apply to all offers, agreements, and services provided by eGateweb, registered in the Netherlands. By accepting an offer (offerte) or purchasing our services, the client fully agrees to these terms.
We operate strictly under Dutch and European Union (EU) legal frameworks. Any deviations from these conditions must be explicitly agreed upon in writing.
2. Our Core Services
eGateweb is an integrated digital agency and IT infrastructure provider. Our services encompass:
- Domain Names: Registration, transfers, and DNS management.
- Server Infrastructure: VPS, Dedicated Servers, Cloud Hosting, and Server Software setup.
- Development: Custom Website creation, Web Applications, and Mobile Applications.
- Digital Growth: SEO (Search Engine Optimization), AI discovery protocols, and digital marketing integrations.
3. Subscriptions & Responsibilities (Crucial)
Many of our services—particularly Domain Registration, Email Hosting, and Server Hosting—are annual or periodic subscriptions. Client commitments regarding renewals are strict:
- Tracking Responsibility: It is entirely the client's responsibility to track the periodic (e.g., annual) renewal dates of their domains, servers, email packages, and associated services.
- Non-Responsiveness: If we attempt to contact you regarding a renewal and you fail to respond or settle the invoice within the designated period, the service will be automatically suspended or terminated.
- No Liability for Data Loss: We do not accept any liability for the loss of data, domains, emails, or business revenue resulting from unrenewed services. Once a server is decommissioned, or a domain lapses, recovery might be impossible.
4. Project Execution & Payment
When contracting eGateweb for custom projects such as web platforms, mobile applications, or specific software builds, the scope, timeline, and value are defined in our official Offer (Offerte).
- Commitment to Value: Once a project is initiated and agreed upon via an Offer, the client is legally bound to pay the total project value.
- Payment Timelines: Payments must be made according to the milestones defined in the agreement. Failure to meet payment schedules may halt development.
- Scope Creep: Features requested outside the agreed Offer will be billed at an hourly rate or re-quoted through a secondary agreement.
5. SEO & AI Visibility
While eGateweb implements best-in-class SEO optimizations and AI visibility protocols based on current algorithms, we cannot guarantee specific rankings on search engines (like Google) or specific appearances in AI model outputs (like ChatGPT or Claude). Search technologies operate on proprietary, ever-changing algorithms heavily influenced by real-world market dynamics beyond our direct control.
6. Limitation of Liability
Under no circumstances shall eGateweb be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses resulting from:
- Your access to or use of (or inability to access or use) our services.
- Any unauthorized access, use, or alteration of your transmissions or content.
- Any interruptions of service due to third-party providers (e.g., global data center outages).
7. Applicable Law and Jurisdiction
These terms shall be governed by and construed in accordance with the laws of the Netherlands and the European Union. Any dispute arising out of or in connection to these terms shall be submitted exclusively to the competent court in the Netherlands.
